Social media platforms now liable for financial scams in EU

The European Union (EU) has passed a new law that makes major social-media and online platforms legally responsible when financial scams originate from content hosted on their services.

Under this legislation, if fraudulent ads or scam content (like fake investment schemes, Ponzi schemes, or impersonation-based frauds) appear on a platform and lead to a user being defrauded — the platform may be required to reimburse banks or victims, if it failed to act after notification or did not remove the fraudulent content promptly. Platforms previously enjoyed broad “intermediary immunity” (i.e. they weren’t treated as the publisher of user-generated content) under older laws — but the new rules significantly narrow that protection for financial-fraud cases.

The new law therefore reflects a shift from simply policing “bad content” to also policing “bad commerce.”
